Documents Needed for Filing Bankruptcy

Perhaps the most common question that is asked by clients is, “What documents do I need to file bankruptcy?” When filing bankruptcy there are items you will want to have when meeting with your attorney. This doesn’t include your government issued ID or your Social Security card that you will want to be sure you have with you at the Meeting of Creditors.

Without question the most essential documents you’ll need when filing for bankruptcy are simply the following:

            1) Two months of pay check stubs
            2) Three months of account statements
            3) The most recent tax return statement filed.

The bankruptcy trustee may obligate you to provide further documents.

Though nothing further is often requested beyond what’s listed above if the trustee asks for more, be ready to provide them all of what they’re requesting and in a timely manner.
If you don’t have wages then you should be prepared to present other documentation showing your income.
If you don’t have any accounts, such as bank accounts or life insurance accounts, then you won’t be expected to submit statements for what you don’t have.
If your earnings have been so low that there hasn’t been a need to file your taxes you will be expected to submit a declaration that reflects your situation.
